Landlord Forum


The Garland Housing Agency administers the Housing Choice Voucher Program which is funded by the U.S. Department of Housing and Urban Development (HUD).  This program enables families to obtain decent, safe, and sanitary housing by subsidizing a portion of the tenant's monthly rent and paying it directly to the property owner.  Any type of private rental housing is eligible to participate in Section 8, including single family dwellings, apartments, and townhouses.  Paperwork is minimal and the owner retains normal management rights and responsibilities, including tenant selection, rent collection, property maintenance, and lease termination.
 
Advantages for Landlords
Section 8 makes excellent business sense to many landlords because it offers several solid advantages in today's variable rental housing market.

LOW RISK- Section 8 removes most of the risk involved in renting to tenants who have limited or unstable incomes.  Landlords are guaranteed to receive a part of the monthly rent (often substantial) directly from the Garland Housing Agency.  Criminal background checks are completed on all eligible clients.

PROPERTY CONTROL- Housing Choice Voucher landlords retain full management control of their property.  They retain the right to screen and select applicants, and if necessary, to evict tenants who have violated the terms of the least agreement.  (Click Here for more information on ZERO-TOLERANCE)

HIGH FLEXIBILITY- Landlords enjoy a high degree of flexibility in their Housing Choice Voucher participation.  GHA's contracts are signed initially for a one year period, and cover each participant on an individual basis.  Paperwork for the landlord is kept to a minimum.  Processing time averages only 15-30 days from the time the prospective renter approaches the landlord to the time the landlord begins receiving monthly Section 8 checks on the tenant's behalf.

RENT REASONABLENESS- Each requested rental rate will undergo a rent reasonableness test performed by our inspectors.  This comparative decision is based on the area in which the unit is located and the size, features, and amenities of the unit.  If the rent is not determined reasonable, the landlord is given the opportunity to provide any additional information that may prove helpful in making the final decision

PAYMENT STANDARDS/FAIR MARKET RENTS- Rents are established periodically by HUD.  The Housing Choice Voucher program requires that rent for a dwelling unit (including utility allowance) is not to exceed the current Fair Market Rent.  Rent for the Housing Choice Voucher program may exceed the Payment Standard provided the rent is determined reasonable for the area by GHA. DAMAGES/VACANCY LOSS- If a Housing Choice Voucher tenant vacates a landlord's rental unit in violation of the lease agreement, the landlord will receive the full contract rent from the Garland Housing Agency for the rest of the month in which the tenant vacated.  Housing Choice Voucher tenants are responsible for any damages they may cause to the unit and landlords are encouraged to cover these expenses with the money collected for the security deposits.

SECURITY DEPOSITS- Landlords are responsible for establishing and collecting security deposits.  Landlords may not charge a Housing Choice Voucher participant a higher deposit than a nonparticipating family.

CONTRACT/LEASE RENEWAL- Before the voucher contract expires each year, the GHA will re-examine the tenant's qualifications, arrange to re-inspect the dwelling unit and review the landlord's status in the program.  If the tenant still qualifies and the review process is satisfactory, a new contract may be signed by the landlord, tenant, and GHA.
